This very important document is subject to revision, however, notice of any changes beyond the level of refinements and clarifications will be given to all customers.

  1. All usage of the services offered by TrafficBlaster Hosting must be in compliance with the laws of the United States of America and the States of Nevada and Illinois.
  2. All documents stored or transmitted using TrafficBlaster Hosting services must be legal to mail across state boundaries in the United States of America. Specifically, if the binary data was transscribed onto a traditional media which does not require computer assistance to be understood, and if the use of the United States Postal Service to carry that media across state lines would be illegal, then it is a violation of this AUP to store or transmit that data using our service.
  3. All users of TrafficBlaster Hosting services will consider all email addresses and all USENET newsgroups to be fax machines for the purpose of determining whether unsolicited data may be transmitted. If it would be illegal in the United States of America to fax someone a copy of a document, that document may not be transmitted using our services.
  4. No email may be sent to more than one hundred recipients except through a mailing list. No post may be sent to more than fifteen USENET newsgroups under any circumstances. This point applies whether the many recipients are listed together in the headers or whether essentially the same mail/post is sent individually to each one.
  5. No adult material may be stored in or transmitted through this service. The definition of adult material is subject to change at any time, but basically means any graphics in any form containing nudity.
  6. This document is included by reference in any contract between the Internet Presence Division of TrafficBlaster Hosting and its clients.

The following commentary is not part of this AUP and any examples given herein are not binding. It is here to help you understand what me mean and what we expect of our customers.

... It would be best not to break any laws in California or Virginia, either, or really those of any state if you can help it ... Your contract specifies harsh penalties for AUP violations. In reality we only intend to cancel accounts and be done with the matter in case of trouble. Unfortunately the possibility exists that any one person's actions could put us out of business, therefore every contract has to allow for this by letting us more easily recover damages. We hope to never invoke the full force of that paragrpah. ... The old adult material definition was "all material of any form which depicts or discusses nudity, sexuality, or abortion, and links to sites publishing such material." Fortunately the Supreme Court noticed that the CDA of 1996 and the Constitution didn't co-exist very well, so the restrictions aren't as strong now. Still, if you are in doubt, ask.
